Terms and Conditions

Welcome to the Passive Fire Protection Association South Africa (PFPA-SA) website. By accessing and using our website (the “Site”) and purchasing any subscription via our WooCommerce platform, you agree to comply with and be bound by the following Terms and Conditions (the “Agreement”). Please read these Terms and Conditions carefully. If you do not agree to these terms, you may not use our Site or purchase any subscription services.

1. Definitions

  • “User” refers to any individual who accesses the Site, including but not limited to customers who purchase a subscription.
  • “Subscription” refers to the services provided by PFPA-SA, which users can access after purchasing a subscription via the WooCommerce platform.
  • “Site” refers to the website operated by PFPA-SA, accessible at https://pfpasa.com/.
  • “Subscription Fees” refers to the payment made by the user to access PFPA-SA’s services for a specified period.
  • “PFPA-SA”, “we”, “our”, and “us” refer to the Passive Fire Protection Association South Africa.

2. Use of the Site

By using our Site, you agree to:

  • Use the Site in accordance with all applicable laws and regulations.
  • Not engage in any conduct that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site.

3. Subscription Services

PFPA-SA provides access to certain exclusive services related to passive fire protection. Subscriptions are available for purchase on our Site, and users can select the appropriate subscription level based on their needs.

Subscriptions may include access to:

  • Industry updates, news, and best practices
  • Training and certification materials
  • Other member-only content

4. Account Registration

To purchase a subscription, you may need to create an account with PFPA-SA. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify PFPA-SA immediately if you suspect any unauthorized use of your account.

5. Payment

All Subscription Fees are due at the time of purchase and must be paid via the WooCommerce platform. We accept payments through Payfast. Subscription Fees are non-refundable unless otherwise stated.

By completing a transaction on our Site, you confirm that:

  • You are authorized to use the payment method.
  • You will pay all Subscription Fees and applicable taxes.

6. Subscription Period and Renewal

Your subscription will remain active for the period specified at the time of purchase. Subscriptions will automatically renew at the end of the subscription period unless canceled by you prior to renewal. Renewal fees may differ from the original subscription cost based on the pricing plan and applicable changes. You will be notified of any changes to pricing before renewal.

7. Cancellations and Refunds

  • You may cancel your subscription at any time through your account settings or by contacting PFPA-SA at info@pfpa-sa.com.
  • Cancellations are effective immediately, but no refunds will be issued for any unused portion of your subscription unless required by law.
  • In the event that PFPA-SA terminates your subscription due to a breach of these Terms and Conditions, no refund will be provided.

8. Content and Intellectual Property

All content on the Site, including text, images, graphics, logos, and videos, is owned by PFPA-SA or licensed to us. You may not copy, modify, distribute, or reproduce any content without explicit permission from PFPA-SA. Users may access and use the content for personal, non-commercial purposes related to their subscription.

9. Limitation of Liability

PFPA-SA is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Site or services, including but not limited to errors or omissions in content, loss of data, or interruption of services. Our total liability shall not exceed the amount paid by you for the subscription during the twelve months preceding the event giving rise to the claim.

10. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which can be found at our Privacy Policy. By using the Site and purchasing a subscription, you consent to the collection and use of your information in accordance with our Privacy Policy.

11. Modifications to the Terms and Conditions

PFPA-SA reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this page, and the effective date will be updated. It is your responsibility to review these Terms and Conditions periodically. Continued use of the Site after changes are made constitutes your acceptance of those changes.

12. Governing Law

These Terms and Conditions are governed by the laws of South Africa. Any dispute or claim arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in South Africa.

13. Costing Centre Usage

  • The PFPA-SA Costing Centre is available exclusively to Professional and Contractor Members for the purposes of tender comparison, BOQ analysis, and cost estimation using data submitted by Affiliated Members.
  • PFPA-SA makes no warranties regarding the accuracy, completeness, or suitability of the price lists, product data, or other information uploaded by suppliers. Users are advised to exercise due diligence.
  • PFPA-SA reserves the right to remove or restrict access to any data or user accounts found to be misusing or misrepresenting information within the Costing Centre.
  • Users agree to treat uploaded pricing information as confidential and not use it for purposes beyond tender preparation or cost benchmarking without express written consent from PFPA-SA.

14. Supplier Data and Responsibilities

  • Affiliated Members uploading price lists and product documents confirm that the data is accurate, current, and reflective of pre-markup rates.
  • Pricing and product information submitted must not misrepresent availability, compliance, or commercial terms.
  • PFPA-SA is not responsible for mediating pricing disputes or enforcing supplier terms.
  • False or misleading submissions may result in removal of data, membership suspension, or legal recourse.

15. Fair Use and Data Confidentiality

  • Access to the Costing Centre and its data is granted solely for legitimate costing and tender preparation by approved members.
  • Users may not reproduce, redistribute, scrape, or resell information from the PFPA-SA platform or its Costing Centre.
  • PFPA-SA reserves the right to monitor activity and suspend access for users suspected of violating this fair use policy.
